Public offer on conclusion of donation agreement of the public association "Biz Birgemiz Qazaqstan 2030"

This public offer (hereinafter- the Offer) is an Agreement concluded between the Contractor and the user of the services - an individual (hereinafter - the Customer), which determines the conditions for the purchase and provision of services using the Contractor's resources.

GENERAL TERMS
In accordance with the Civil Code of the Republic of Kazakhstan, this proposal is a public offer (hereinafter - “Offer”).
In this Offer, terms are used that have the following meaning: “Donation” – “donation of a thing or right for generally beneficial purposes” “Donor” – “citizens making a donation” “Recipient of the donation” –NGO “Biz Birgemiz Qazaqstan 2030”.
The offer is unlimited from the moment it is posted on the website of the project NGO "Biz Birgemiz Qazaqstan 2030" -https://bizbirgemiz.kz (hereinafter- the Project). The Fund has the right to cancel the Offer at any time.
The Fund is ready to enter into donation agreements in a different manner and (or) on other terms than those provided for in the Offer, for which any interested person has the right to apply to the Fund to conclude an appropriate agreement.
SUBJECT OF THE AGREEMENT
Under this agreement, the Donor, as a voluntary Donation free of charge, transfers his own funds by any payment method to the Fund's current account, and the Fund accepts Donations and uses them for statutory purposes or transfers them to other funds for charity. The fact of transfer of the donation indicates the Donor’s full agreement with the terms of this agreement.

CUSTOMER STATUS
The Fund does not conduct commercial activities and does not aim to make a profit.
The Fund publishes information about its work and performance reports on its website.

MAKING A DONATION
The donor independently determines the amount of the voluntary donation, but not less than 1000 tenge in accordance with the Terms of the Project and contributes it by transferring funds to the Fund’s bank account through the Fund’s website or by any other method under the terms of this Agreement.
The maximum amount of donations is 10,000,000 tenge.
The fact of transferring the Donation to the Fund’s account indicates the Donor’s full agreement with the terms of this agreement.
Donations to the Fund are not subject to VAT;
When transferring a Donation, in order to correctly identify the payer, the Donor indicates his contacts: email address and telephone number.
The date of acceptance of the Offer and, accordingly, the date of conclusion of the Agreement is: the date of receipt of the Donor's funds to the Fund's current account or, in appropriate cases, to the Fund's account in the payment system.

RIGHTS AND OBLIGATIONS OF THE PARTIES
The Fund undertakes to use the funds received from the Donor under this agreement strictly in accordance with the current legislation of the Republic of Kazakhstan and within the framework of its statutory activities.
The Donor gives the Fund consent to the processing of personal data provided by the Donor when making a voluntary donation (full name, address, place of residence, email address, bank details), including to third parties (based on an agreement with the Fund), for the purposes of the execution of this agreement, including the following actions: collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data. In all other cases, the Fund undertakes not to disclose the Donor’s personal information to third parties without his written consent. The exception is when this information is required by government agencies that have the authority to require such information. Consent to the processing of personal data is valid until the Donor revokes it in writing.
The Donor has the right to receive information about the use of the Donation. To exercise this right, at the request of the Donor, the Fund is ready to confirm the intended use of the Donations received with the relevant accounting documents.
The Fund does not bear any other obligations to the Donor other than the obligations specified in this Agreement.

OTHER CONDITIONS
In the event of disputes and disagreements between the Parties under this agreement, they will, if possible, be resolved through negotiations. If it is impossible to resolve a dispute through negotiations, disputes and disagreements may be resolved in accordance with the current legislation of the Republic of Kazakhstan in the courts at the location of the Fund.
